You need two things to look at
1. Is the copyright and distribution laws that would cover the music
2. Is any local laws regarding a business.

2 is easy call city hall. 1. is hard call the state bar association and ask for a lawyer who is into the copyright law stuff.

If you play rock you are gunna make more money than someone who plays jazz or blues due to the teenages, they tend to buy rock, metal, hip-hop, punk, and indie, that sort of thing. A very good way to promote your music is myspace and even no name bands get looked at a lot more than you would think.
